We are immune cause we cant be traced and we can use anysoftware we want on our computer in case they do trace some how

you are fairly off base here. The courts have begun to say the software is not illegal, but illegal use of the software is. The makers of the software are held liable if it can be shown they inteded the use of the program to be for illegal purposes. If file sharing programs were inhernetly illegal, MS would be in for a treat (Windows file sharing...).
