I woulden't be so quick to call them cheaters. ATI has done the exact same thing in the past.

then ati is loosers also, at least they did not do it when the competition was fearce, they did it just to stay alive haha.

The world of 3D Graphics has changed dramatically with the latest generation of highly programmable GPUs. For example, Futuremark's PCMark2002 has different CPU test compilations for AMD's AthlonXP and Intel's Pentium4 CPUs.
3DMark03 is designed as an un-optimized DirectX test and it provides performance comparisons accordingly. It does not contain manufacturer specific optimized code paths. Because all modifications that change the workload in 3DMark03 are forbidden, we were obliged to update the product to eliminate the effect of optimizations identified in different drivers so that 3DMark03 continued to produce comparable results.
However, recent developments in the graphics industry and game development suggest that a different approach for game performance benchmarking might be needed, where manufacturer-specific code path optimization is directly in the code source. Futuremark will consider whether this approach is needed in its future benchmarks.

If you thought that just one company was tweaking its video driver settings, you were wrong. Many companies tweak there products a little. Just look at LCD panels, the contrast ratio is not also what they say on the box. Monitor makers have been changing numbers for years. A 15" crt monitor is not actually 15", it is 14.5", etc.

Man I love controversy hahaha I know this topic would bring in the haters weather it is nvidia or ati hahaha, I have owned and used both, both rock and both are pretty much equal driver wise now "I like the ati drivers better now" The ati cards have proven themselves to "ME" to be more reliable than various brands of nvidia cards by a slim margine that I have owned when heavily overclocked and stresed. And no none of you can argue with me except probably cik who has owned probably as many cards because I have owned 7 different 4200 ti's, 1 4400ti and 4 different 4600ti's as well as 6 different versions in the mx linup all in the last 1 1/2 years. I have also owned and have receipts and leftover stock heatsinks for 5 9700 pro's and 3 9800 pro's  so unless you have first hand experience with as many recent cards don't bother to speak and be a "review reading only authority"

businesses cheat, nothing new, as said both companies have done it
i've only had 1 ATI (8mb xpert@play) and 1 GF3, not really comparable
though i prefer nvidia for their better *nix support (even though i don't use it atm)

That's the thing... nVidia isn't cheating. They are utilising the technologies that are actually used in the games that are played so that you can get a true game performance comparison. ATI does the same, but they do it with intentions of misleading consumers, not leading consumers to a correct path. nVidia's 5900 is not really much ahead of ATI in raw performance, but it sure does choke the 9800's in real (life) performance.
